End User License Agreement

1. Acknowledgment

This Agreement is between you and RaceTracker, not Apple or Google.

  • RaceTracker, not Apple or Google, is solely responsible for the App and its content.
  • Apple and Google have no obligation to provide maintenance or support services.
  • Apple and Google are not responsible for addressing any claims relating to the App.

2. Scope of License

RaceTracker grants you a limited, non-exclusive, non-transferable, revocable license to use the App on mobile devices you own or control, subject to an active subscription.

You may:

  • Download and install the App on your compatible devices.
  • Use the App to discover race tracks, view events, and access community features.
  • Access all features available through your active subscription.

You may NOT:

  • Copy, modify, distribute, sell, lease, or reverse engineer the App.
  • Remove or alter any proprietary notices within the App.
  • Use the App for unlawful or unauthorized purposes.
  • Share your account credentials with any other person.
  • Interfere with or disrupt the App or its services.

3. Subscription and Accounts

A paid monthly subscription is required to access RaceTracker features. This applies to both Track Owners and Racing Fans.

Track Owner Subscription:

  • Includes full track profile management, race schedule publishing, event creation, and fan-facing visibility.

Racing Fan Subscription:

  • Includes full access to all track listings, race schedules, nearby discovery, community feed, favourites, and event reminders.

All subscriptions are billed on a recurring monthly basis through your app store account (Apple App Store or Google Play). Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Fees are non-refundable except as required by applicable law or app store policy.

You must:

  • Provide accurate and complete information when creating your account.
  • Maintain the confidentiality of your account credentials.
  • Notify us immediately at support@racetracker.app of any unauthorized use of your account.

4. Notifications

The App may send notifications related to:

  • Subscription status and billing reminders.
  • New race events and track updates from tracks you follow.
  • Community feed activity and interactions.
  • App updates and new features.
  • Account-related activity.

You can manage notification preferences in your device settings at any time.

5. User Content & Objectionable Content

5.1 User Content

Track Owners and Racing Fans may submit content such as track listings, event details, community feed posts, photos, and comments.

  • You retain ownership of your content.
  • You grant RaceTracker a license to display and use this content within the App.
  • You are solely responsible for the content you post.

5.2 Prohibited Content

You agree not to post content that is:

  • Illegal, abusive, harassing, or obscene.
  • Infringing on intellectual property rights.
  • Misleading, fraudulent, or deceptive (including false track or event information).
  • Containing malware or harmful code.
  • Promoting hate, discrimination, or violence.

5.3 Content Moderation

RaceTracker reserves the right to:

  • Review, remove, or restrict content that violates this Agreement.
  • Suspend or terminate accounts that repeatedly violate policies.
  • Take necessary action to protect users and comply with the law.

6. Intellectual Property

All content, trademarks, logos, software, and intellectual property within the App are owned by RaceTracker or its licensors and are protected by applicable laws. You may not use any intellectual property without prior written permission.

7. Maintenance and Support

RaceTracker is solely responsible for providing support for the App.

Apple and Google have no obligation to provide any maintenance or support services for the App.

8. Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided “AS IS” and “AS AVAILABLE.”
  • No warranties are made regarding performance, reliability, or availability.
  • RaceTracker does not guarantee uninterrupted or error-free operation.
  • RaceTracker does not guarantee the accuracy of any track listing or race event information published by Track Owners.

In the event of a failure to conform to any applicable warranty, Apple’s and Google’s sole obligation is limited to refunding the purchase price (if any) paid through their respective platforms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • RaceTracker shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
  • RaceTracker’s total aggregate liability to you for any claim shall not exceed the total subscription fees you paid to RaceTracker in the three months preceding the claim.
  • Apple and Google have no liability whatsoever related to the App.

10. Legal Compliance

You agree to comply with:

  • Apple App Store and Google Play Store Terms of Service.
  • All applicable local, state, federal, and international laws.

You represent that you are not located in a country subject to a government embargo or designated as a restricted country by applicable authorities.

11. Third-Party Beneficiary

Apple and Google and their subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

12. Termination

You may terminate this Agreement at any time by cancelling your subscription and deleting the App.

RaceTracker may suspend or terminate your access if:

  • You violate this Agreement.
  • Your subscription lapses and is not renewed.
  • The App is discontinued.
  • Required by law.

Upon termination, your license ends immediately and access to all subscription features will cease.

13. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the App after changes indicates acceptance of the updated terms. Material changes will be communicated via in-app notice.

14. Governing Law

This Agreement is governed by the laws of the United States, without regard to conflict of law principles.

15. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force and effect.

16. Entire Agreement

This Agreement, together with RaceTracker’s Privacy Policy and Terms & Conditions, constitutes the entire agreement between you and RaceTracker regarding the App.
